ELIGIBILITY: Registrants must be 25 years or older as of January 1, 2023.  3. Void where prohibited by law or as otherwise determined by VacationOffer.com (VO).  4. All federal, state and local laws apply.  5. By participating, you unconditionally agree to and accept these Official Rules and to  the decisions of VO which are final and binding in all respects.  7. HOW TO PLAY: The Giveaway shall begin September 1, 2023 and end on December  31, 2024.  Eligible Participants may enter by visiting the promotion location. The Participant will register  for “the GIVEAWAY” as directed by filling in his / her required information and signing the  entry form. First name, last name, phone number, email address and city/state of residence  are all required information and must be valid to participate and to claim vacation prize.  9. A Valid entry is defined as a delivered entry where all required information is valid,  completely filled in and signed by Participant / Registrant. 10. RESTRICTIONS: One entry per participant. Households, couples, or groups traveling  together will count as one participant. No more than the number of prizes set forth in  these official rules will be awarded.  11. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY VO WHOSE DECISIONS  ARE FINAL AND BINDING. A PARTICIPANT IS NOT A WINNER OF ANY PRIZE UNLESS  AND UNTIL SAID CONTESTANT’S ELIGIBILITY AND THE POTENTIAL WIN HAS BEEN  VERIFIED AND SAID CONTESTANT HAS BEEN NOTIFIED THAT VERIFICATION IS  COMPLETE AND ANY DOCUMENTATION NECESSARY FOR VERIFICATION HAS BEEN  SUBMITTED TO VO OR VO’S DESIGNEE FOR VERIFICATION. VO WILL NOT ACCEPT  ANY OTHER EVIDENCE OF A WIN IN LIEU OF ITS VALIDATION PROCESS.  12. No transfer, or assignment of a prize will be permitted, except VO reserves the right  to substitute the prize with another prize of comparable value.  13. VO and the promotion location are not responsible for any typographical or other error. 14. PRIZES: Odds of winning depend on number of entries.  Twelve (12) “Fabulous Florida Getaway” Grand Prize(s) will be awarded by VO:  1. 5 day / 4 night Orlando accommodations package for two adults. 2. 3 day / 2 night accommodations package for two in choice of Clearwater, FL or  Miami, FL for two adults. 15. SELECTION OF WINNERS AND NOTIFICATION: Grand Prize Winners will be selected  in a random drawing on or about the 15th of each month for the previous month’s  registrants / participants from all eligible entries received by VO during the Giveaway  for that month in question.  16. The Grand Prize winners will be notified via the phone number and/or email provided  on original entry and is required to respond within three (3) business days of the first  notification.  17. VO’s winner decision is final. Grand Prize winner will be required to sign and return  (within 10 days) an Affidavit of Eligibility and Publicity / Liability Release, and IRS W-9  Form. Affidavit of Eligibility must be complete and include winner’s social security or  resident alien identification number.  18. If grand prize winner(s) is/are ineligible, fails to return the notification call as required,  fails to claim a prize or fails to return the completed and executed Affidavit / Release  as required, or if the prize is returned as non-deliverable, winner will be deemed  ineligible and prize will be forfeited or awarded to an alternate as solely determined  by Sponsor.  19. By accepting a prize, winner releases and discharges VO, and its respective affiliated  companies, and the promotion location, from any liability or damage due in whole  or in part to the award, acceptance, possession, use or misuse of any prize or from  participation in this Giveaway.  20. By their participating, a winner, except where prohibited by law, grants VO, VO’s designee  and their affiliated companies the right to use the winner’s name, likeness, picture,  portrait, hometown, voice, biographical information and written submissions  and written or oral statements, for advertising and promotional purposes without  additional compensation unless required by law.  21. DISQUALIFICATION / TERMINATION: VO, the promotion locations and any other  companies involved with or otherwise providing services related to this Giveaway are  not responsible for lost or destroyed entries.  22. Persons found tampering with or abusing any aspect of this Giveaway, and persons  entering or attempting to enter more than once, as solely determined by the Sponsor,  will be disqualified. In the event any portion of this Giveaway is compromised, VO  reserves the right, at its sole discretion, to suspend or terminate the Giveaway. VO  reserves the right, in its sole discretion, to cancel, modify, extend, or suspend the  Giveaway at any time.  23. MANDATORY ARBITRATION REQUIREMENT AND CLASS ACTION WAIVER: Any  controversy, claim or dispute between the parties arising out of or relating to this  agreement, contest and/or promotion or the breach, termination, enforcement,  interpretation, conscionability or validity thereof, including any determination of  the scope or applicability of this agreement to arbitrate, shall be determined by  arbitration in Iron County, Utah in accordance with the Laws of the State of Utah.  24. The parties agree that the arbitration shall be administered by a nationally  recognized arbitration service pursuant to its rules and procedures. The arbitrator  shall be neutral and independent. The award rendered by the arbitrator shall be final  and shall not be subject to vacation or modification.  25. Under no circumstances will a participant be permitted to obtain awards for, and  participant hereby waives all rights, to claim punitive, incidental and consequential  damages and any other damages, other than for actual out-of-pocket expenses, and  any and all rights to have damages multiplied or otherwise increased.  26. Judgment on the award made by the arbitrator may be entered in any court having  jurisdiction over the parties. The parties agree that either party may bring claims  against the other only in his/her or its individual capacity and not as a plaintiff or  class member in any purported class or representative proceeding. Further, the  parties agree that the arbitrator may not consolidate proceedings of more than one  person’s claims, and may not otherwise preside over any form of representative or  class proceeding. The parties shall share the cost (not attorneys’ fees) of arbitration  equally unless otherwise required by law or the arbitration rules. In the event a party  fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or  fails to comply with the arbitrator’s award, the other party is entitled to costs of suit,  including a reasonable attorney’s fee for having to compel arbitration or defend or  enforce the award. The arbitration requirement and class waiver shall survive any  termination and completion of this promotion, and the parties to it agree that it shall  apply to all promotions that are related to, offered with or subsequent, by this sponsor  or any subsequent promotion. In all respects, the parties expressly intend and agree  to bring all claims arising or related to this promotion through binding arbitration.  27. All Participants expressly consent to be contacted via phone by VO via text or call  at the phone number provided, even if it is a mobile number, using an auto dialer,  regarding VO’s Giveaway and their travel services.  28. By registering for this Giveaway, any winners expressly consent and request to be  contacted via telephone, mobile phone, mail, email, and/or text message (standard  rates apply) at the number(s) and address(es) provided by the Sponsor regarding  this Giveaway, their travel services and vacation ownership products even if such  number(s) have been registered on the national and/or state do not call lists.  29. All participants agree that VO, and their affiliates, and any other persons involved in  the design, administration, or fulfillment of this Giveaway and the promotion locations  (herein the “Releasees”) shall not be liable for and hereby release and agree to hold  harmless each of the Releasees from liability, injury, damage, expense, cost, or loss  of any kind or nature resulting from participation in this Giveaway or acceptance of,  receipt, use or misuse of any prize. 30. Registrants to be offered the Promotional Package described in Rule 30 must meet  the age requirement in Rule 2 and the following additional qualifications:  1. Must be either Married or Cohabitating with another individual, in the same  dwelling, on a permanent “full time” basis.  2. Registrants must also possess a Debit Card or Major Credit Card for check-in  purposes only. 3. Registrant gross household income must exceed $50,000 yearly.  32.
